Sales Tax and Business License Review

The Panhandle Professional Photographers Guild meeting for February was devoted to understanding the rules, regulation and requirements of operating a business in Florida and collection of Sales Tax for the Department of Revenue.

Joshua Allen, CFCA, MBTO, Director of Business Collections, Okalossa County

Mr. Allen spoke to the guild about the license requirements of doing business in Florida and the  requirement of have a business license, occupational license or tax certificate which ever the county you are dealing with it happens to call their form of business regulation.

Basically you are required to obtain a "certificate" to work in any county in which you do business if that county requires you to do so. The definition of doing business is "providing a service". It does not matter where your "office" is located or where your "financial transactions" occur. If you  photograph a client in that county, you are required to have a "certificate" to do so.

As and example, if you run your business out of your home or office located in Escambia County and you photograph clients on Okaloosa Island, you are then required to be registered/licensed to do business in both Escambia and Okaloosa counties. Walton county does not require an occupational license, however if you are located in the city limits of certain cities, you are then required by that city to obtain and occupational license.

Bottom line, pay the small fee for any county that you photograph clients in. It's better to pay the small fee yearly than to be fined if or when you get caught. If you are unclear as to what the requirements are for your county and city, call them and find out.

Department of Revenue, Sales and Usage Tax

Shirley Pridgen, DOR, Panama City Service Center

MS. Pridgen spoke to the Guild on the proper collecting and filing of Florida Sales tax. Below are the hand outs that she supplied us with during the meeting along with a few notes that I took. Sales tax is crazy and complicated and we all know that if you ask five people a question, you will get five different answers. So to protect yourself, get the answer you need in writing! You can call (850)617-8346 to get information to submit your questions in writing and get a written response that will cover you if/when you get audited.

For what it’s worth, here is my take on the information we received. As I said, get you own questions answered in writing and be protected.

Session fees:

Session fees are TAXED IF: you charge a session fee and a sale of products is produced from that session and the products are delivered to the client in the state of Florida

Session fees are NOT TAXED IF:you charge a session fee and all products are shipped outside of the state of Floirda

Session Fees are NOT TAXED IF: No sale of products occurs from the session.Example: your clients lives in Florida, you charge a session fee, however the client never orders a product, no sale occurs, the session fee is then non-taxableWhat amount do you charge for sales tax?

The Florida (FL) state sales tax rate is currently 6%. Depending on local municipalities, the total tax rate can be as high as 7.5% To determine the rate that you would charge your Florida clients, you have to find out what the tax rate is for the county in which you are DELIVERING THE PRODUCT, not the county in which your business resides. If you are unsure as to what you should be charging, again getting it in writing from the DOR!

Hope this information helps some of you and enables you to understand what questions you need to ask the DOR so that you know that you are running your business correctly.

Below are the hand outs that we received from at the meeting. You may need to increase the print size on your screen by pressing "cmd +" on Mac and "cant +" on PC

If anyone else who attended the meeting remembers something that I might have missed or left out, please feel free to add your information in the comment section below.

Intro to DSLR Video with Kevin Almodovar

These days most of our DSLRs are capable of more than just photography but if you haven't delved into the video function before it can seem intimidating to explore.

To aid in making sure that incorporating video into your business or personal use will be a little easier, we will be welcoming Kevin Almodovar of Revive Media Services to discuss:

    •    Gear that will aid your video to have stability or motion on
         your terms
    •    Camera settings and modifiers
    •    Types of lighting to enhance the look of your video
    •    Importance and methods for capturing sound
    •    Methods of editing and combining your video footage after you've
        captured it.

It should be great introduction if you have ever considered adding video to your toolbox.

We look forward to seeing everyone after a busy summer!

Tuesday, May 27th: Merit and Adjust

Marty Grivjack, knows what it takes to create a merit image and you should too.

Entering your local, state, district or international competition is one of the best ways to push yourself to be more. And you'll learn where you stand—how your photography matches up with your peers. Marty will talk about the 12 elements of a merit image, and how to incorporate them into your daily photography.  Even if you don’t compete, your photography will only improve if you shoot and edit as if every images was going to competition.

Marty Grivjack, a PPA Photographic Craftsman, is a professional photographer and Lightroom instructor residing in Jupiter, Florida, with a summer studio on Lake George, New York. He is the past-president of PPGPB, The Professional Photographer’s Guild of the Palm Beaches, and member of PPA, ASP, FPP, PPSNYS and CCPPSNYS. Marty conducts Lightroom™ and Photoshop™ workshops, PPA Super Monday programs, seminars and schools.

Bring images on a USB drive that you would like to have critiqued.

During our Social hour, 5pm to 6pm:

Auto-focus Micro measurement and correction.

Have you ever looked at one of your portraits and found that the ear of your subject was in focus and the eyes were not.  Are you concerned that maybe your lens are not “spot on” and providing razor-sharp auto focusing performance.

Bring your camera and lens to Tuesdays meeting and during the social hour, 5 pm to 6 pm, have it check with a Spyder Lenscal target.

The Problem:

Photographers have enjoyed the benefit of autofocus for 25 years now, but many still struggle with its accuracy and repeatability. Auto-focus is a great convenience, especially in fast shooting situations. But typically the first step in reviewing files from a shoot is tossing all the images where the focus isn’t quite right. This can be motion blur or other issues, but one of the most frequent causes is auto-focus error. We tend to blame this on the camera choosing the wrong object, or the wrong point on the object as the focal point, but there is another possibility, one we hate to consider, given the price of the hi-end lenses we use: the auto-focus of our lens may simply be off. When you take a simple shot of a flat object perpendicular to the camera, and it still isn’t quite as sharp as it should be, you have to accept that this may be the cause.

The Solution:

Many newer DSLR cameras now offer a method to correct this issue: they allow you to store auto-focus correction data for several of your most important lenses. This feature is likely to become more common, and appear in other camera types.  Spyder lenscal™ provides a fast, reliable method of measuring the focus performance on your camera and lens combinations. It allows photographers to obtain razor-sharp focusing or check to see that their lenses are working at their peak performance.

Help-Portrait: December 7th

Today, December 6th starting at 11 am at Catholic Charities in Fort Walton Beach, we will be setting up lights and equipment so anyone that wants to help out with that and see the lighting formulas that we will be shooting with is welcome to join. We will be using 3 shooting stations so we will go through the procedures 3 time with different people leading. A great opportunity to see how to do studio set ups on location or just to see how others set up.

Catholic Charities is providing the space for tomorrow's shoot and will be lining up family groups (each of which includes 1 or more people).  They will also be providing a cookout with food for the families and for volunteers.  They are also in contact with Northwest Florida Daily News and WEAR ABC TV in hopes of having the event covered by media. We will be providing 8x10 prints (or 8x10 sheets with multiple prints) of each family.  We will also provide digital files of images to each family, if possible.

Tomorrow we will be shooting in shifts and everyone that wants to shoot will get the opportunity.  We will also need a few well versed at Lightroom to assist in editing and printing portraits. Volunteering will be divided into shifts: 9am-11:30am, 11am-2:00pm and 1:30pm - 3:30pm

Please contact Mari ( or Cathy ( to let us know which shift you prefer.
